New Employer Workplace Labor Posting Requirement
Beginning Nov. 14, employers are required to post notices informing their employees of their rights to unionize under a final rule issued by the National Labor Relations Board (NLRB). The rule exempts from the notification requirement very small retail employers with a "gross annual volume of business" of less than $500,000.
Private-sector employers are required to post the 11 by 17 inch employee rights notice on employee workplace bulletin boards where other state and federal workplace notice posters are typically displayed. The notice must be conspicuous to all employees and maintained and updated by the employer as necessary. The poster is approved for black and white or color format. Translation must be posted at workplaces where at least 20 percent of employees are not proficient in English. Employers must also post the notice on an internet site if personnel rules and policies are customarily posted there.
The NLRB says it will not initiate enforcement action on its own for an employer's failure to post the notice. However, the NLRB said it could investigate cases based on complaints by employees or other parties. Failure to post the notice could constitute an "unfair labor practice" under the National Labor Relations Act.
